In the lawsuit it filed on July 28, 2022, the PDP requested that Tinubu and Shettima be disqualified from running in the 2023 presidential election. It was claimed that Shettima's nomination as Tinubu's running mate amounted to double nominating, which is against the rules of Sections 29(1), 33, 35, and 84(1)(2) of the Electoral Act, 2022, as amended.
Shettima's nomination to run for vice president and the Borno Central senate seat, according to the party, was illegal.

The case had already been dismissed by the Court of Appeal and the Abuja Federal High Court.
The PDP requested that the Supreme Court overturn the Court of Appeal's ruling that the party had not proven its locus standi, arguing that Shettima's disqualification for multiple nominations might prevent Tinubu from being sworn in as president because they jointly fielded a ticket.
