Martin Amaewhuke led 27 members of the Rivers State House of Assembly, who have been ruled current members of the Peoples' Democratic Party by a Rivers State High Court. On Monday, the Court dismissed a lawsuit brought by Wosa Amadi and three other parties, who wanted the seats of the 27 MPs to be declared vacant due to their defection to the All Progressives Congress in December 2003. As to the ruling of Justice Okogbule Gbasam, the Presiding Judge, Martin Amaewhule and the other 26 MPs remain members of the PDP.
In addition, Justice Gbasam declared that the claimants had not demonstrated to the court that the 27 MPs had switched to the APC, emphasizing that there is no way to verify this allegation through newspaper articles, radio spots, or internet postings. The party membership record, a membership card, and the fulfillment of all membership requirements by the affected members are the only ways, the court ruled, that a defection may be proven.
